Dear Valued Charter Customer:
 
To confirm your trip, you must verify the charter information and immediately return a signed copy with the required deposit as listed on the attached contract.  Please be aware of the special policies regarding deposits cancellations, changes, and damages.
 
DEPOSITS:  A deposit of $100.00 per coach is required to hold your reservations for all day trips (NO EXCEPTIONS).  A deposit of $200.00 is required for all overnight or extended day trips.  Deposits are NON-REFUNDABLE.  (NO EXCEPTIONS)
 
PAYMENTS:  **WE ACCEPT CREDIT CARD PAYMENTS, (VISA, MASTERCARD AMERICAN EXPRESS, DISCOVER CARD) with a completed and signed Credit Card Authorization form.   Payments/Deposits can be made by personal check only if approved by management and only if made (30) days or more prior to date of scheduled departure.  All other payments must be made by certified check, cashiers checks, money order or official company/business/bank checks.  Please indicate on your mode of payment where possible the date of your trip and your confirmation number where applicable or if assigned one to insure proper credit.  Final payment for your trip must be made no less than (14) days prior to the date of departure unless otherwise approved.  Cash payments are accepted with suitable arrangements and a receipt will be issued along with a copy of your agreement.  Cash payments made on the day of your trip MUST BE APPROVED BY MANAGEMENT NO EXCEPTIONS.
 
CANCELLATIONS:  The “Chartering party/Group leader” must notify Howard Motorbus 30 days or more prior to scheduled trip/departure in order to receive a FULL refund for credit towards their next trip if applicable.  Cancellations within the 30 day grace period are refunded less the required deposit.
 
CHANGES:  Please notify Howard Motorbus of any changes in itinerary prior to the date of your scheduled trip.  It is suggested that changes to any trip, itinerary or destination(s) be made within 15 business days of your scheduled trip or additional charges may apply.  Howard Motorbus drivers/contractors will only take passengers to destinations indicated on the contract unless notified in advance.
 
FORCE MAJEURE:  Neither party shall be liable or delay in performing obligations set forth in this agreement and neither party shall be deemed in breach of its obligations.  Such failure(s) or delay(s) due to natural disasters, government authority, strikes, labor disputes, restrictions in travel, inclement weather, security requirements (federal or other), acts of war or terrorism, acts of “God”, the issuance of a Homeland Security Advisory System notice of a Severe or Code Red terrorist threat that results in the closure of attractions or cancellation of scheduled events due to such, or any other matter in which neither party has NO control, including disturbances in the ability to provide transportation, law regulation(s) or ordinance(s), or any cause beyond the reasonable control of Howard Motorbus or chartering party.  Howard Motorbus Industries, LLC agrees to provide transportation in clean, smoke free comfortable equipment either its’ own or sub-contracted to its’ customers as indicated in its’ advertising and as governed by the local Public Service Commission.
 
LIMITS OF LIABILITY:  Neither party shall be liable in any event or for any reason, including breach of this agreement or contract(s), either directly or indirectly to the other party or any third party for any special, indirect, incidental, punitive, exemplary or consequential damages or loss of profits arising out of this agreement, even if such damages were foreseeable or either Party has been advised of the possibility of such damages.
 
NO ASSIGNMENT:  The “Chartering Party’ or Group” may not assign this agreement or any of their respective rights, interests, duties or obligations hereunder without the prior consent of the party or parties involved.  “The Company” may assign this agreement and any of its rights, interests, duties or obligations hereunder without the prior written consent of the “Chartering Party’ or Group”, meaning, at times we overbook, this is a common practice in this industry. If the situation arises and we absolutely have to sub contract or "farm out" your bus to another company we will (A) inform you in advance (unlike most companies) therefore you will not be surprised come the day of your trip (B) we guarantee similar/like or better services at the same rate (we won't book it, farm it out and take a cut we pay them what you pay us) and finally (C) this will be on your Transportation Agreement prior to the day of your trip, you will receive a reminder or courtesy the day before with all the information in regards to your carrier and there driver. 
 
ENTIRE AGREEMENT: This agreement constitutes the entire agreement between the parties and supersedes any and all other agreements, either oral, written with respect to the subject matter hereof.
